Pfizer has agreed to pay a total of £6.3 billion to settle US-based erectile dysfunction (ED) claims and to pay a total of £4.9 billion for the settlement.

The UK’s patent on Viagra expired in November 2017 but the US’s patent expired in December 2017. Pfizer agreed to pay a total of £2.2 billion to resolve the claims and to resolve the settlement. It said the settlement would result in a 5 per cent royalty on future sales.

The US firm also said it had reached an agreement with a US partner to settle patent litigation.

The agreement, which will be subject to formal approval by Pfizer, is expected to be in effect from 1 January, 2013.

Pfizer said it expected a “long-term solution” to the patent settlement.

It said the deal will help Pfizer achieve its ambition of becoming the world’s first pharmaceutical company to sell over-the-counter Viagra. The deal would allow the company to launch a generic version of the medication, known as Sildenafil, in September 2014.

The company will be entitled to royalties on sales of the erectile dysfunction drugs based on sales data received from the FDA. As part of the agreement, Pfizer will also receive $5 billion to resolve a US class action lawsuit against US-based generic drug maker, Teva Pharmaceutical Industries Ltd., which had suffered patent loss in 2011.

Pfizer said it was not aware of any other agreements or litigation in the US and that it was not planning to hold a patent challenge until the agreement is in place.
